President Trump’s immigration strategy is to deploy U.S. employers as a “virtual wall” against foreign and undocumented workers. How does that impact you?

Employers will face several new immigration-law changes this year: stepped-up worksite I-9 audits and raids, restrictions to foreign employee visas, increased fines on non-compliance and enforcement levels, possible mandatory use of E-Verify … and more. Plus, employers are still trying to figure out the new “Smart I-9” form they must complete for each new hire.

Key issues employers will have to encounter in 2018 as a result of the change in immigration policy are

  • Increased worksite I-9 audits and raids. Complete internal I-9 audits to stay compliant and make necessary corrections to I-9 forms to avoid potential fines; use E-Verify to verify work authorization.
  • Mandatory use of E-verify. E-Verify compares information from an employee’s Employment Eligibility Verification Form I-9 to data from U.S. government records. As of now Some states have passed legislation making it mandatory for certain businesses, other states require all employers use E-Verify.
  • Increased scrutiny on H-1B visas, with regard to job expertise and wages. The H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations that require theoretical or technical expertise.
  • Plan in advance for workers having DACA, TPS, or H-4 employment authorization documents (EADs) concerning renewals and decide on alternative course of actions.
  • Expect immigration compliance site visits, particularly for H-1B, H-2A and H-2B, and L-1 employers.
  • Delays in green card approvals. A new report on US Homeland Security operations says Green Card applications are taking more than double the amount of time to process because of the “complexity” involved in the process and unrealistic time goals from the US government side. Anticipate USCIS interviews of employees and their family before approval of employer-sponsored green card applications.
